| Permanent Residence allows an individual to legally reside in
Canada without any conditions on the time they can remain or
restrictions on their ability to work. People who are settled in
Canada are also free to travel out of and into Canada provided, generally, they do not stay out of
Canada for more
than three years in a five year period. This is known as the returning residents rule.
There are a number of
means to secure permanent residence in Canada that are normally
dependent on the person's existing status and length of residency in
Canada to date, or their ability to qualify for programs available
through Citizenship and Immigration Canada.
For example, a spouse of a
Canadian citizen or resident, with permission to remain in this
country on the basis of their marriage, would be eligible under the
In-Canada Spousal class and therefore could apply for permanent
residence in Canada under that program.
In general, to apply for permanent
residence, an application needs to be made to Citizenship and
Immigration Canada on an official application form and include all
relevant supporting documentation.
